Introductory provisions

These warranty and claim conditions regulate the relationship between BIOLAMPA, s.r.o. (hereinafter also referred to as the "Seller") and the end customer (hereinafter also referred to as the "Buyer"). Furthermore, the relations between the Seller and the Buyer in the case of claims are governed by the Civil Code and the Commercial Code.

All deliveries of goods are subject to the following warranty and claims conditions. The Buyer accepts the validity of the warranty and claim conditions by collecting the goods from the Seller and by this act they come into force for the Buyer.

Obligations of the Buyer

Acceptance of the goods and liability for defects:

The Buyer shall inspect the Goods immediately upon receipt. If mechanical damage to the packaging of the product is detected, the Buyer is obliged to inspect the condition of the goods and, in the event of damage, to make a record of the damage in the presence of the carrier. Liability for damage during transport is borne by the carrier as all goods are insured. On the basis of the record made, the buyer will be granted a reasonable discount or a new product will be delivered, as a rule, immediately after the conclusion of the damage claim with the carrier, at the latest within 30 days. Claims for mechanical damage to the product (scratches, cracks, breakages, ...) that were not detected upon receipt of the shipment cannot be accepted.

The buyer is obliged to check the completeness of the packaging upon receipt of the product (personal and non-personal). Upon delivery by courier, the buyer must draw up a complaint report on the spot about the incompleteness of the packaging. Upon personal collection, the buyer is obliged to check the contents of the package immediately, additional claims will not be accepted.

Before putting the equipment into operation, the buyer is obliged to:

  • Familiarize himself with the instructions for use of the purchased equipment/equipment,
  • become familiar with the warranty conditions of the equipment, including the Slovak instruction manual, and then follow this information,
  • if necessary, register with the manufacturer or distributor of the equipment.

    Warranty period and warranty conditions

    BIOLAMPA, s.r.o. refuses to accept any liability for defects and damages resulting from the buyer's failure to familiarize himself with the instructions for use and the warranty conditions of the equipment, for damage or destruction of the equipment, for the loss of any data or programs operated by the buyer.

    Liability rights shall be exercised with the seller from whom the item was purchased. However, if there is another business designated for repair (authorized repair center) that is in the location of the seller or in a location closer to the buyer, the buyer shall exercise the right to repair with the business designated to perform the warranty repair. If the repair cannot be arranged in this way, the Seller shall arrange the repair.

    If the goods are covered by a guarantee, the defect must be notified and claims arising from the defect in the goods must be made before the end of the guarantee period. Upon expiry of the warranty period, the right to make a claim shall cease.

    The Buyer shall not have any claim or right to warranty repair against BIOLAMPA, s.r.o. other than that set out in these Conditions. BIOLAMPA, s.r.o. warrants all equipment supplied to the Buyer to the following extent:

    • material or manufacturing defects in computer equipment supplied by BIOLAMPA, s.r.o. which are caused by manufacturer's error and occur during normal operation

    Seller's liability for defects in goods or services

    If the defect is one that can be rectified, the buyer has the right to have it rectified free of charge, in a timely and proper manner. The seller is obliged to remedy the defect without undue delay.

    The buyer may, instead of having the defect removed, require the item to be replaced or, if the defect relates only to a part of the item, the part to be replaced, provided that the seller does not incur disproportionate costs in relation to the price of the goods or the seriousness of the defect.

    According to 622 § 3 Oz: The seller may always replace the defective item with a faultless one instead of removing the defect, if this does not cause the buyer serious inconvenience.

    If there is a defect which cannot be removed and which prevents the thing from being properly used as a thing without defect, the buyer has the right to have the thing replaced or has the right to withdraw from the contract. The same rights shall apply to the buyer if the defects are remediable, but if the buyer is unable to use the object properly because of the recurrence of the defect after repair or because of a greater number of defects.

    If there are other irremediable defects, the buyer is entitled to a reasonable discount on the price of the item.

    The warranty does not apply to:

    • equipment with a broken seal
    • equipment which has been arbitrarily dismantled or its components replaced by the purchaser
    • defects caused by unprofessional intervention, installation, repair or modification by the purchaser
    • equipment from which the serial number has been removed, destroyed, obviously altered or stolen
    • malfunctions caused by violent treatment
    • failures caused by failure to use original consumables for the equipment
    • faults caused by the use of other parts, materials not intended for use with the product
    • malfunctions caused by neglect of routine maintenance
    • malfunctions caused by operating the product outside the operating conditions specified in the instructions for use
    • faults caused by using the equipment in a manner other than that recommended or for which the equipment was designed and rated, faults caused by excessive use and wear and tear
    • malfunctions caused by the operation of the product in an environment at the purchaser's premises which poses a safety or health hazard
    • malfunctions caused by the use of software not intended for use with the product
    • malfunctions caused by force majeure, accident, fire, water, atmospheric discharge, power surges, earthquakes, etc.
    • faults caused by transport, non-compliance with storage and transport conditions by the purchaser
    • consumables - toners, tapes, printer cartridges, floppy disks, CD/DVD media, etc.
    • normal wear and tear of items (or parts thereof) caused by use. A shorter product life cannot therefore be considered a defect and cannot be claimed

    BIOLAMPA, s.r.o. provides warranty and post-warranty repairs of computer equipment (hereinafter referred to as equipment), BIOLAMPA, s.r.o. BIOLAMPA, s.r.o. guarantees that the equipment will be fully functional throughout the warranty period and will comply with the applicable standards of the manufacturers of such equipment (provided that the original accessories are used). Post-warranty repairs are carried out through the service department and authorized service centers. For post-warranty service BIOLAMPA, s.r.o. charges a fee for the work performed in accordance with the valid price list. The price list is available at the central service administration at BIOLAMPA, s.r.o. headquarters.

    The duration of the warranty is extended by the duration of the repair. If the equipment is replaced, the warranty starts again from the receipt of the new item. All replaced parts of the equipment and equipment replaced under warranty remain the property of BIOLAMPA, s.r.o.

    BIOLAMPA, s.r.o. reserves the right to make use of service services provided by authorised service centres of equipment manufacturers, if required to ensure their functionality.

    Complaint procedure

    Please observe the following procedure when making a claim:

    • Thoroughly familiarize yourself with the warranty and service conditions of the product that were included in its packaging.

    When requesting service intervention under the warranty conditions, it is necessary to document:

    • a description of the defect in the equipment, its type designation and serial number
    • proof of purchase, a copy of the invoice
    • the equipment packed in appropriate packaging (to prevent damage to the goods during transport)
